A 48-year-old man from Troms was sentenced by the Supreme Court to three years in custody for threats. He was previously convicted of double murder.

The man was convicted in 1998 of having killed two random people in Dyrøy in Troms with a knife. He was sentenced to 18 years in prison for the murders.

In autumn 2014, he was released after serving the custodial sentence.

He began a relationship a short time after, but the relationship between them ended. The man put forward threats to kill the former girlfriend, about suicide in her presence and to kill random people.

Just three and a half months after the completion of his sentence for double murder, the 47-year-old was again arrested and in January this year sentenced for death threats in Nord-Troms District Court. He was sentenced to detention for two years, but appealed the ruling.

Hålogaland Court of Appeal in May increased the custodial sentence to three years.

The Court of Appeal’s judgment shows that a timed imprisonment for these threats would have been five months in jail. Containment judgment of the appellate court is seven times as long, and can be extended.

The 48-year-old appealed both the question of guilt and detention to the Supreme Court, which refused to treat the question of guilt, but which has now upheld the detention ruling from the Court of Appeal.

The Supreme Court concluded that there was such a close connection between the murder actions in the 1990s and the new crime that conditions of detention were met.
