It was called historical when four former CEOs in the fertilizer company Yara were sentenced to several years in prison for gross corruption last summer. This week their appeal begins.
Yara’s matter was referred to as Norway’s most serious corruption case ever since the trial proceeded in Oslo District Court for over two and a half months in the winter 2015.
Four former top executives, including former CEO Thorleif Enger, stood accused of gross corruption in Libya and India.
The District Court was charged with dealing with, Enger, former legal director Ken Wallace and former Executive Vice President Tor Holba. The convicted all involved, while tidigere director of Yara’s growth strategy, Daniel Clauw, was convicted of India relationship, but acquitted in Libya case.
Enger got strictest punishment of three years in prison, while the three co-defendants received between two and two and a half years in prison.
All appealed
All four deny guilt and appealed. Also prosecutors appealed – both sentencing and acquittal of Daniel Clauw for Libya relations.
The prosecutor, Marianne Djupesland in ØKOKRIM originally asked the court about six years in prison for Enger and Clauw, seven years in prison for Wallace and three years in prison for Holba.
Tuesday an appeal starts in Court, and it will continue until mid-December.
Thorleif Enger was managing director of agricultural water and chemicals for Yara from 2004 to 2008. He also sat as chief executive for many years in Hydro for Agri, the precursor to Yara.
The judgment states that Enger “gave its approval to the people in his management team, committed corruption, thus proving that corruption was accepted in Yara.”
