A 42 year old man was convicted of having assaulted a train ticket inspector after a ticket check, but got a lower penalty because the fight came after he paid.
It was at Vestfoldbanen station last October that the man was accused of turning on a conductor after having to pay a fee of 40 kroner, according to Drammen Tidende newspaper.
According to the insult, the fight wasn’t hard, but caused short-term pain.
The 42 year old was charged with physical violence and preventing occupational work to an exposed occupational group.In February he was acquitted by Asker and Bærum District Court, but the verdict was appealed, and on 1 June the case was resumed in Borgarting Court of Appeal.
The accused himself claimed he came to the conductor when he got up, but a police witness who saw the incident supported the conductor’s explanation.
However, the man in the court of appeal was acquitted of trying to influence occupation because the tussle came after he had paid the fee.
‘’There is no evidence that, by this act, he sought to influence the conductor’s occupation,’’ it stated in the judgment.
Thus, the man received a much lower punishment than the police’s 15 day imprisonment,’’ wrote the newspaper. He was sentenced to a fine of 2,000 kroner.
