Cabin owners take corona case to European Court of Human Rights in Strasbourg

Norwegian cabin owners with cabins in Sweden did not win in their corona lawsuit against the state in the Norwegian court system, so they are now taking the case to the European Court of Human Rights in Strasbourg.

The Norwegian cabin owners filed a lawsuit against the state because quarantine requirements were introduced when entering the country from abroad during the pandemic.

They were upheld in Oslo District Court but lost in the next round in the Borgarting Court of Appeal. The case went on to the Supreme Court, which supported the argument that the corona measures interfered with the cabin owners’ rights. Nevertheless, the court decided that their rights had not been violated because the interventions were justified.

Taking the case to Strasbourg

The cabin owners are now taking the case before the Human Rights Court in Strasbourg. The group claims that the state has violated its right to housing under Article 8 of the Human Rights Convention.

“The ruling in the Supreme Court has given the authorization to take intervention measures without justifying them or presenting the assessments behind the intervention measures,” they wrote in the press release.

The verdict weakens not only the group’s legal protection but all citizens’ legal protection during crises, they believe.

“Minimal risk”

In the complaint, the cottage owners write that the state has prevented them from utilizing their properties without any infection control-related reason.

“The professional assessments made by the authorities indicated that the risk of infection was minimal. 

“Nevertheless, the authorities did not follow their own professional assessments but maintained the quarantine obligation without giving any professional justification for why it was necessary,” they added.
