A nursing assistant in his 20s has been sentenced to imprisonment for one year and two months by Sør-Trondelag District Court for sexually assaulting a mentally retarded man.
The care assistant was accused of having obtained sexual favors by abusing his position. Four months of prison sentence was suspended, writes Adresseavisen.
The sexual abuse the man has now been convicted of, occurred in April and May last year. Police learned of the case when the victim himself contacted the sheriff’s office. According to the verdict the nursing assistant, among other things, invited the victim to his house and performed sexual acts on him.
The aggrieved party has a mild mental retardation. According to a report used as a part of the court proceedings , he has an cognitive level corresponding to a child between six and nine years.
The aggrieved explained in the judicial examination that he did not dare to say no to a nursing assistant’s overtures, and did not dare to stop the sexual acts.
In addition to the prison sentence the care assistant has to pay 100,000 kroner in damages to man.
