The Court of Appeal has sentenced a man in his 30s to three years and three months in prison for raping a sleeping woman.

The incident happened in 2019 at the woman’s home in Asker. She had invited the accused and another man to her home, where they drank alcohol.

At one point, the woman became so drunk that she went to bed. The accused then went up to the bedroom where she was lying. During the trial in the Borgarting Court of Appeal on Thursday last week, the woman explained that she woke up because the man abused her but that she could not do or say anything.

The accused, for his part, said that he did not remember anything from the night, and he did not admit criminal guilt.

However, the Borgarting Court of Appeal ruled that the man was guilty and sentenced him to three years and three months in prison. He also has to pay NOK 125,000 in reparation to the woman.
